eInstruction Corporation於2009年7月1日向美國國際貿易委員會(International Trade Commission; ITC)請求對QOMO HiteVision, LLC公司提起337調查，主張被告QOMO HiteVision, LLC侵害eInstruction Corporation所擁有之US 6,930,673號專利，詳見表一。起訴書中，指出被告QOMO HiteVision, LLC公司所製造之「QIT30Prodigy Interactive Wireless Tablets」產品侵害eInstruction Corporation的專利，進而對該公司提出輔助侵害(Contributory Infringement)的主張。並請求美國海關執行永久一般性排除命令(Permanent General Exclusion Order)或永久限制性排除命令(Permanent Limited Exclusion Order; LEO)及ITC停止命令(Cease and Desist Order)的行政救濟，禁止一切QOMO產品繼續進口美國並且禁止繼續銷售侵害US 6,930,673號專利的相關產品。

一、公司簡介
原告 eInstruction Company
成立於1980年，主要是研發教學所使用之小型手持式(Small hand-held)的互動性教學系統(Classroom Performance System，CPS)。在2006年該公司併購生產Examview產品的FSCreation公司；緊接於2008年併購Interwrite Learning公司，並提出了Interwrite Workspace Software，該軟體整合eInstruction、FSCreation與Interwrite Learning公司的產品，廣泛的被全世界超過90多個國家所使用。
被告QOMO HiteVision, LLC
主要是生產與教學有關的產品，主要產品線為Document Camera、Interactive Panels、Digital Signage Software、Audience Response與Interactive Whiteboards。此次與系爭專利產品屬於Interactive Panel產品線之Q30 Prodigy Interactive RF Wireless Tablet。
二、系爭專利之技術與應用狀況
本次所牽涉專利是屬於協同輸入系統(Collaborative Input System)的技術，主要應用於學校。該專利已經被廣泛的使用於eInstruction的產品Interwrite Mobi (Model IP500)與Interwrite Pad (Model SP400)中，該技術主要提供以學生為中心的學習環境，亦即老師與學生利用互動輸入式設備，同時對於上課教材相互溝通與討論。老師於上課題目張貼之後，可以立即看到學生的回答，使老師可以根據學生的回答做出不同的指導。
三、證據收集
eInstruction在向ITC請求337調查之前，已經先針對QOMO HiteVision, LLC使用該專利的情況做出詳細調查，並且清楚列舉其合約號碼並且分析其產品無線手寫板(Wireless Tablet)的用途。根據資料顯示，QOMO HiteVision, LLC分別於2007年8月28日與2009年3月17日從香港進口”QIT30 Prodigy Interactive Wireless Tablets”進入美國境內。並且從QOMO HiteVision, LLC與其他廠商交易紀錄中找出編號 06-S7188的合約販賣此商品，最後表明本案無線手寫板並無其他非侵權用途(no non-infringing uses)，因此主張該產品輔助侵害(Contributory Infringement)
四、訴之聲明
(一)請求ITC對於QOMO HiteVision是否侵害US 6,930,673專利立即做出調查
(二)判定是否違反337條款
(三)提出對可能侵權廠商提起永久一般性排除命令((Permanent General Exclusion Order)以及永久限制性排除命令(Permanent Limited Exclusion Order)，對於其上下游廠商，以及未來可能以進口的方式進入美國境內之侵權物品，提出禁止進口與生產的主張。
(四)請求ITC發佈停止命令(Cease and Desist Order)之行政救濟，禁止一切QOMO HiteVision侵害US 6,930,673專利的產品繼續在美國境內銷售。
