一、訴訟案件概述
美國Affinity Labs於2011年1月28日向東德州聯邦地方法院Beaumont分院，提起對Volkswagen專利侵權訴訟請求，如表一；並於訴狀中，指出 Volkswagen所生產之2011年車款中的整合可攜式音樂播放器(Portable Audio Player)至汽車螢幕顯示器以及使用者介面(User Interface) 的相關設計，侵害Affinity於2008年1月29日所取得的可攜式音樂播放器以及車用音響系統(Sound System)的連接方式專利。
除了上述專利之外，Affinity Labs一併提出另外兩件專利侵害的請求，分別為US 7,634,228內容傳遞的方法與系統專利，以及多媒體的管理方法US 7,778,595專利，且上述專利皆屬於同一專利家族(Patent Family)。

二、專利訴訟歷史
Affinity Labs自2008年3月起，陸續向東德州聯邦地方法院對國際知名的汽車廠商如Toyota, Benz等等提起車用電子相關的專利侵權訴訟 (如表二所示) 。在過去所提起的五次專利訴訟之中，其中三次即是以US7,324,833為系爭專利，再加上此次於2011年1月所提出之訴訟，總計利用該專利向超過 20家以上的音樂播放器製造商以及汽車大廠提起專利侵權相關訴訟。

三、系爭專利家族
根據Affinity Labs所提起之系爭專利，主要集中在IPC分類號H04R5/02(揚聲器，麥克風，留聲機的拾音器或類似的音響電氣機械轉換器；助聽器；公眾演講系統 電視系統之零部件)、H04H 40/00(廣播通信，專門用於接收廣播資訊的配置或設備)與H04Q7/20(選擇，網路拓撲，利用已建立的連接進行選擇性呼叫之設備)三大專利分類號 下。其中US7, 324,833已經被Affinity Labs多次用來對不同的公司提起專利訴訟。
該專利家族的發明人皆為White Russell W.，根據表三所示，除了此次的系爭專利之外，尚有另外三件專利並沒有在此次專利訴訟中出現。該三件專利為US7,187,947、 US7,440,772、US7,486,926皆與車用電子相關。值得注意的是US7,486,926專利和此次訴訟專利US 7,634,228的標題完全相同，極有可能在未來的專利訴訟之中出現。(767字；表3)
