2012 年 4 月 25 日，美國克羅拉多州的專利授權公司 Potter Voice Technologies LLC,( 下稱 Potter Voice) 於美國克羅拉多州地方法院控告包含 Apple 、 Google 、 HTC 、 Samsung 、 Nokia 、 RIM 等共 26 家手機與軟體大廠侵犯其語音控制專利。
本案爭議專利為 US5,729,659 ：「以語音輸入控制數位電腦的系統與其方法 (Method and apparatus for controlling a digital computer using oral input ) 」。係由獨立發明人 POTTER, JERRY L 於 1995 年 6 月 6 日提出申請，並於 1998 年 3 月 17 日取得專利權。 2011 年 11 月 18 日， POTTER 將本專利轉讓給一專利授權公司－ Empire IP, LLC ， Empire IP 再於 2012 年 4 月 3 日將本專利轉讓給 Potter Voice 。
請參閱第 6 圖所揭露的語音輸入控制數位電腦的系統，與第 10 圖之表格資料結構 (a tabular data structure) 示意圖。如該兩圖所示，本爭議專利所揭露的系統至少包含一接收單元 ( 如圖中的麥克風 11) 、一字元識別單元 12 、一數位電腦 116 。其中，該數位電腦中包含一搜尋單元 118 、一儲存單元 120 、一內容確認單元 124 、與一執行單元 122 ，又該儲存單元 120 內存有資料及該表格資料結構。
本爭議專利的技術特徵在於，將一語音訊號 (oral inputs) 透過接收單元 110 傳送至該字元辨識單元 112 後，字元辨識單元 112 將根據該語音訊號產生一輸入資訊 (input information) ，該搜尋單元 118 將依據該輸入訊號的至少一部分，搜尋出該表格資料結構中與該輸入訊號有關的內容，再以該內容確認該表格資料結構內容與該輸入訊號內容的相關程度，最後再交由執行單元 122 予以執行。
Potter Voice 於訴狀指出，由於美國 Apple 、 Google 、泛泰 (Pantech) 、 Research In Motion 、 Microsoft 、摩托羅拉 (Motorola) ；台灣的宏達電 (HTC) ；中國的中興 (ZTE) 、華為 (Huawei) ；韓國三星 (Samsung) 、樂金 (LG) ；日本索尼 (Sony) 、京瓷 (Kyocera) 、夏普 (Sharp) ；與芬蘭 Nokia ，使用或銷售了包含本爭議專利所保護的語音控制軟體或電腦產品，因此請求法院判決被告們停止損害並支付賠償。
據調查，網路上目前尚查無 Potter Voice 的明顯的活動資料，但應與 Empire IP 有高度關連。根據美國專利轉讓登記資料庫所示， Empire IP 受讓取得有 7 件專利，專利代理人為紐約市的 DANIEL MITRY( 與辦理本爭議專利轉讓給 Potter Voice 的代理人相同 ) 。 (741 字；表 1)
