2012 年 9 月 10 日，印度最大、同時亦是世界級的雙軸延伸聚丙烯膜（ Bi-axially Oriented Polypropylene Films, BOPP ）製造大廠 Cosmo Films Ltd. 、其美國分公司 Cosmo Films, Inc.( 下稱 Cosmo) ，向美國馬里蘭州聯邦地院提告，控告中國最大 預塗膜 (thermal lamination film) 製造商北京康得新複合材料公司之美國分公司 KangdeXin America LLC ( 下稱 KDX) ，其所製造販售之防捲曲尼龍膜 (anti-curl nylon film) ，就 Cosmo 所擁有、製造防捲曲書本紙質封面之方法專利構成誘使侵權 (induced infringement) 與輔助侵權 (contributory infringement) ，因為前述產品誘使或輔助其購買者去實施、受本案系爭專利所保護之製造方法。
在本案訴狀中， Cosmo 同時控告 KDX 不法取得其所保護之營業秘密，原因是曾擔任 Cosmo 執行副總裁之 Keith Borcz ，在 2010 年 9 月離職後現擔任 KDX 之總裁，而 Cosmo 指陳， Keith Borcz 將其任職 Cosmo 期間所獲知、有關本案系爭專利之授權條件等機密資訊，不法洩漏給 KDX ，讓 KDX 取得不當商業利益，進而構成對 Cosmo 營業秘密之侵害。
本案系爭專利為美國專利編號 US 5,626,969 ，名稱為 「製造用於覆膜之薄膜的方法 ( Method of manufacturing film for lamination ) 」，於 1997 年 5 月 6 日核發，原始權利人是 General Binding Corporation(GBC) 。 Cosmo 於 2009 年 6 月併購了 GBC Commercial Print( 其為 ACCO Brands Corporation 與 GBC 合併後的一分支部門 ) ，並在當時取得本案系爭專利之權利。
Cosmo 在併購 GBC Commercial Print 後在世界預塗膜產業中取得領導地位 。而 KDX 為中國成長快速之企業之一，根據資料顯示，其預塗膜年產能從 1.6 萬噸提升至 4.4 萬噸，而有超越 Cosmo 取得該產業領導地位的態勢。本案專利侵權與營業秘密侵害之告訴，或者是兩家公司在美國市場激烈競爭的展現。 (654字；表 2)
