Medtronic(以下簡稱MDT)與Edwards Lifesciences(以下簡稱Edwards)兩家公司均為醫療器材產業大廠。Medtronic公司產品線，特別專注於心血管手術產品、微創手術產品、糖尿病照護管理產品、外科影像導航軟硬體設備、神經脊椎泌尿科及耳鼻喉科等診斷手術設備，2009年營業額為146億美金，全球排名第四[1]。Edwards產品主要為心血管支架、人工心臟瓣膜等產品，目前為全球人工心臟瓣膜出貨量第一的廠商，2011年第一季營業額即達到2.4億美金[2]。
人工心臟瓣膜主要用在治療主動脈瓣膜狹窄疾病，若施以藥物的治癒率並不高，而開胸是大手術容易有極大風險，不適用於老年人與有其他疾病之病患[3]。目前，因影像醫學及Hybrid Operating Room手術房而有瓣膜置換術出現。
自1992年，已有醫師證實不須使用開胸手術，透過心導管植入人工心臟瓣膜的可行性。1993年，丹麥醫師ANDERSEN於歐洲申請”心臟瓣膜與置放心臟瓣膜之心導管”專利並獲證EP0592410 (以下簡稱’410號專利)，之後也向美國專利局申請並獲證US 5,411,552 (以下簡稱’552 號專利)。之後這兩項專利均授權給Edwards公司。此種手術方式可減低病人手術後復原時間，以及減低感染風險。2002年法國Cribier醫師之團隊，完成了首例於人體之心導管主動脈瓣膜置換術，成功植入了一牛心包膜之人工瓣膜[4]。全美目前在約有10萬名病患等待接受經皮人工瓣膜置換，約為全球病患的1/3。
Edwards本身擁有超過100項以上的心臟瓣膜相關專利[5]，Sapien transcatheter valve(圖1)已於2011年11月獲得美國FDA許可上市，與MDT子公司CoreValve所生產Generation 3 ReValving(圖2)為目前新型之動物組織瓣膜，其主要是將牛組織製成的瓣膜葉縫在金屬支架上後，放置於鈣化或硬化之瓣膜處，以解決因瓣膜硬化而心臟無法輸出正常血流的問題。
MDT與Edwards在歐洲針對心臟瓣膜專利上已纏訟多年。2007年5月，Edwards在德國法院控告MDT的子公司CoreValve所生產Revalving系統產品，侵犯先前所提到之’410號專利，同年6月CoreValve於德國慕尼黑法院，回告’410號專利無效。2010年1月，德國法院判定專利有效。2010年2月，德國上訴法院確認其事實，並判定CoreValve侵犯專利。在英國部分，2007年5月CoreValve於英國倫敦法院告’410號專利無效，2009年1月，英國法院判定該專利有效，但CoreValve產品並未侵權。2010年5月，英國上訴法院確認專利有效，雙方仍持續在歐洲上訴。
在美國，雙方的訴訟戰也是如火如荼展開。2008年2月，Edwards向美國德拉威地方法院控告MDT下子公司CoreValve的產品CoreValve's Generation 3 ReValving產品侵犯其所擁有專利三項：US5,411,552、US6,168,614與US6,582,462。2010年4月，美國德拉威地方法院判決，CoreValve惡意侵犯Edwards之US 5,411,552號專利中之第一條權利項，因此Edwards可獲得7390萬美金的賠償，但CoreValve不須停止販賣與銷售產品，Edwards就此部分繼續上訴。2011年2月，德拉威法院再次確認此項判決。
MDT不甘示弱，於是在2011年6月，分別向明尼蘇達州地方法院(6/24)，以及加州中區地方法院(6/27)，提出訴訟，控告Edwards所生產的Sapien transcatheter valve，侵犯其所擁有專利三項[8]：US6,004,330、US7,468,073與US7,503,929，更在2012年3月2日，向加州中區地方法院控告Edwards公司侵犯其所擁有之US7,184,829與US8,036,741專利[9]。其中US7,468,073與US7,503,929專利分別為和心臟瓣膜有關的專利，而其他三項專利則是用MDT心律調節器以及神經刺激器的專利，來控訴Edwards的產品侵犯專利。
隨著全球老年化以及狹心病人口越來越多，心血管疾病醫療器材的市場將會持續增長，廠商之間的競爭仍會持續下去，MDT挾著有龐大的資源，相信會透過專利戰持續攻擊對手，而各大廠之間的專利戰爭也將會持續延燒。(1209字；表2；圖1)
