Comcast在美控告BT之MPLS與視訊會議服務侵犯其多項專利

2012年6月1日,美國有線電視與寬頻網路服務業者Comcast,以其企業集團內四家公司Comcast Cable Communications, LLC、Comcast Mo Group, Inc.、National Digital Television Center, LLC與Comcast IP Holdings I, LLC為共同原告,向美國北德州聯邦地院提起專利侵權告訴,控告英國電信(British Telecommunications,下稱BT)跨國企業集團之五家公司British Telecommunications plc、BT Group plc、BT Americas, Inc.、BT Conferencing, Inc.與BT INS, Inc.,在美國境內營運多協定標籤交換(Multiprotocol Label Swtiching,MPLS)電信網路以及提供視訊會議(teleconferencing)服務等行為,分別侵犯其所擁有之6項專利權利。

Comcast在訴狀中指出,BT在全球許多國家營運其MPLS網路服務,而北美地區為其「關鍵市場」,亦擁有許多大型企業客戶;Comcast認為BT的MPLS網路侵犯其3項專利:

US 7,142,508,名稱為「控制網路中資料傳輸率之系統與方法(System and method for controlling data transfer rates on a network)」,2006年11月核發,原始權利人為Radiance Technologies, Inc.;

US 5,638,516,名稱為「以選擇輸出埠到後續節點並傳送路徑確定訊號回先前節點之方式在節點間確立傳輸路徑的並行處理器(Parallel processor that routes messages around blocked or faulty nodes by selecting an output port to a subsequent node from a port vector and transmitting a route ready signal back to a previous node)」,1997年6月核發,原始權利人為nCUBE Corporation;

US 6,212,557,名稱為「在分散網路資料處理系統中同步更新之方法與裝置(Method and apparatus for synchronizing upgrades in distributed network data processing systems)」,2001年4月核發,原始權利人為Compaq Computer Corporation。

而至於BT所提供的視訊會議服務,Comcast則認為是侵犯其2項專利權利:

US 5,752,159,名稱為「在互動網路中自動收集並傳送應用程式事件資料的方法(Method for automatically collecting and delivering application event data in an interactive network)」,1998年5月核發,原始權利人為U.S. West Technologies, Inc.;

US 6,115,035,名稱為「影音自動典藏與配送之系統與方法(System and method for automated audio/video archive and distribution)」,2000年9月核發,原始權利人為MediaOne Group, Inc.;

此外Comcast亦控告BT所提供之網路管理產品與服務,侵犯其下述專利:

US 6,487,594,名稱為「ISP業者控管規則管理之方法與系統(Policy management method and system for internet service providers,2002年11月核發,原始權利人為MediaOne Group, Inc.。

本案有趣的是,Comcast提出這5項系爭專利都不是自行研發而得的技術。

Comcast是美國最大有線電視提供商,因應寬頻網路衝擊而積極布局媒體娛樂事業,2009年12月3日宣佈,將以137.5億美元的代價,買下奇異公司手中美國電視電影 NBC環球的51%股份,想鞏固自己在數位匯流時代的地位。(882字;表2)
